These General Terms and Conditions of Sale (hereinafter the “General Terms and Conditions” or “Terms and Conditions” or “GTC”) apply to any purchase made by an individual consumer (hereinafter the “Client” or the “Buyer”) from the seller:

These General Terms and Conditions of Sale govern the sale of services ordered by Clients from the Seller.
The following terms have the meanings given below:
“Client” refers to the contracting party of the Seller, who guarantees having the legal status of consumer as defined by French law and jurisprudence. Accordingly, the Client is expressly defined as a natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal or agricultural activity.
Any order necessarily implies unconditional acceptance of these General Terms and Conditions of Sale by the Client.
Article 1 – Scope and Application
These General Terms and Conditions apply to the following services:
– Ski and snowboard lessons, telemark, cross-country skiing – Organisation, instruction, and guiding of on-piste and off-piste outings (ski, snowboard, snowshoeing, cross-country skiing, telemark) – Organisation and guiding of heliski outings
1.1 Services – Liability of Instructors
All instructors working for VAL D’ISERE SKI INSTRUCTORS hold certified ski and/or snowboard instructor qualifications obtained in France or abroad.
The services take place in a mountain environment, which is inherently unpredictable.
Participants are responsible for their own safety and that of others, and must follow the instructions given by the instructor or guide for safety reasons. The instructor or guide is bound by a best-efforts obligation (obligation de moyens). Participants are solely responsible for the choice, maintenance and monitoring of their equipment, including theft, breakage, or any damage.
VAL D’ISERE SKI INSTRUCTORS cannot be held liable for any problem related to participants’ equipment, nor for accidents caused by participants before, during, or after the services.
1.2 Insurance
Instructors of VAL D’ISERE SKI INSTRUCTORS carry professional civil liability insurance covering them in the exercise of their duties, as well as participants while under their supervision.
This insurance does not cover: rescue costs, medical care, theft or breakage of ski equipment, or the cost of unused lift passes.
Participants are advised to verify that they are covered for these risks and, if not, to purchase suitable insurance (such as “Carré Neige”, available at lift-pass sales points).
1.3 Entire Agreement
These General Terms and Conditions express the entire obligations of the parties. The Buyer accepts them without reservation.
They apply exclusively over any other terms and conditions unless expressly accepted by the Seller.
The sale is deemed concluded on the date of acceptance of the order or immediate purchase.
The Buyer acknowledges having read and accepted these General Terms and Conditions prior to placing the order.
Article 2 – Order – Price
An order refers to any request for services accepted by the Seller, accompanied by payment of any required deposit.
Any order received is deemed firm and final.
Prices are fixed, final, expressed in euros, and inclusive of taxes.
Article 3 – Quotations
For services requiring a quotation, the sale becomes final only after issuing the quotation and sending the Client confirmation of acceptance.
Quotations are valid for 1 month.
The Client must accept the quotation within the following timeframes:
– More than 3 weeks before the start date → acceptance required within 7 calendar days – Less than 3 weeks before the start date → acceptance required within 2 calendar days – In all cases → acceptance must occur before the start of the service
Article 4 – Performance of Services and Termination
Unless otherwise agreed, the service will be performed on the date specified in the quotation, after the Seller receives a valid order.
If no date is agreed, the Seller must perform the service within 30 days of the contract.
If the Seller fails to perform within the agreed timeframe, the Buyer may terminate the contract under Articles L.216-2 to L.216-4 of the French Consumer Code.
Except in cases of force majeure, deposits are non-refundable.
Article 5 – Distance Selling and Right of Withdrawal
The 14-day withdrawal right under Article L221-18 of the Consumer Code does not apply, pursuant to Article L221-28 (12°), since the services are leisure activities provided on a specific date.
Article 6 – Cancellation or Modification of Services
6.1 Cancellation or Modification by the Client
No modification may be made less than 10 days before the start of the services.
Modification requests are treated as cancellations followed by a new booking. Additional costs may apply.
Only written requests (email or letter) will be taken into account.
Refund conditions:
– More than 8 weeks before → 90% refund – Between 8 weeks and 21 days → 50% refund – Less than 21 days → no refund
Participants must arrive at the scheduled meeting time and place. Absence or late arrival → no refund.
Weather-related cancellations are not accepted unless due to force majeure or full closure of ski lifts in the sector.
6.2 Cancellation or Modification by the Professional
The professionals may modify the programme at any time due to weather, safety, or inability to replace an instructor.
If the activity is cancelled, an alternative date will be proposed (subject to availability). If none is available, the Client will receive a full refund within one month.
For safety or quality reasons, professionals may refuse or exclude a participant who jeopardises the activity. No refund will be granted.
6.3 Special Covid-19 Conditions
If the service must be cancelled due to lockdown, travel bans, border closures, or other government restrictions, the service will be postponed if possible, otherwise refunded within one month.
For interruptions during the week due to government decisions, refunds will be prorated.
Article 7 – Payment
Unless otherwise agreed:
– Booking more than 3 weeks ahead → full payment due within 15 days – Booking less than 3 weeks ahead → full payment due within 3 days – In all cases → full payment must be received before the start of the service
Payments are considered final only after effective receipt.
Advance payments bear legal interest after 3 months until service performance.
An invoice will be provided upon request.
Article 8 – Guarantees
VAL D’ISERE SKI INSTRUCTORS guarantees conformity under Articles L217-11 and following of the Consumer Code and Articles 1641 and following of the Civil Code.
The Buyer must report defects within 7 days of service delivery.
Refunds will be made within 30 days.
The guarantee is limited to reimbursement of the services paid.
Article 9 – Intellectual Property
All documents (technical documents, products, drawings, photographs, etc.) remain the exclusive property of VAL D’ISERE SKI INSTRUCTORS and must be returned on request.
Clients agree not to use or disclose them in any way that infringes intellectual property rights.
Article 10 – Jurisdiction
Any dispute relating to these General Terms and Conditions shall be submitted to the competent courts under French law.
The Seller elects domicile at its registered office.
Article 11 – Contract Language
These Terms are drafted in French. In case of translation, only the French version prevails.
Article 12 – Consumer Mediation
Mediation may only occur after the Client has attempted to resolve the dispute directly with the company.
If no response is received within 2 months, the Client may refer the matter to the consumer mediator:

Article 13 – Data Confidentiality
Personal data is stored and used only as needed to manage requests, contact clients, manage user profiles, provide online access, or conduct statistical analyses.
Data is retained only as required for service performance unless legal retention rules apply.
Clients have rights of access, rectification, deletion, limitation, portability, or objection.
